TERMS & CONDITIONS
These terms and conditions set out below apply to the purchase of any original Artwork or limited edition Artwork from Cezanne, Gallery of Fine Arts.
All paintings/Work of Arts displayed on the Website are supported by an authenticity guarantee from the artist.
1 . Confirmation of The Client Purchase and Pricing.
The Client will be issued a purchase invoice containing details of the Artwork the Client have agreed to purchase. This will include the agreed sale price inclusive of VAT. At this point a legally binding contract upon these terms and conditions comes into existence.
2. Payment.
Payment for the Artwork is to be made within 03 days from the date of invoice,otherwise the agreement will invalid.
3. Guarantees.
Purchases of Original Artwork are issued with a valuation pack and limited edition Artwork that has been published by us comes issued with a certificate of authenticity.
4. Delivery/Collection of Artwork.
Online order will deliver inside Dhaka in 5 days and Outside Dhaka in 10 days.
Collection of the Artwork will be made by The Client from our premises, either at the time of purchase or at any other date and time so agreed.
Delivery and installation of original Artwork can be arranged via our professional hanging services at a date and time so agreed. This service will incur extra costs payable by The Client.
If arrangements for collection or delivery of the Artwork have not been made within 30 days from payment date we reserve the right to charge storage fees.
For overseas and export orders, the cost of shipping, import taxes and fees will be payable by The Client.
5. Title and Risk.
Title and risk in the Artwork shall pass to The Client when The Client take possession of the Artwork, the risk of damage to or loss of the Artwork will pass to
The Client and The Client will be responsible for insuring the same.
6. Ownership and Copyright.
In accordance with the copyright, Designs and Patents act 1911 Bangladesh, copyright of the Artwork shall remain the property of the Artist at all times.
The Client may not produce any image of the Artwork and may not, at any time,publish or submit for publication or reproduction of any image of the Artwork to any third party, including any internet website, for any purpose unless an agreement has been made with the Artist.
7. Data Protection.
By agreeing to these terms and conditions The Client confirms that The Client are aware of and consent to the use Cezanne, Gallery of Fine Arts of any personal data within the meaning of the Data Protection Act 2022 and the General Data Protection Regulations 2022. The Gallery will not pass on Client personal details to any third parties. The Gallery will keep a record of The Client personal details primarily for invoicing purposes and to exchange communications with The Client about The Client orders if necessary.
8. Cancellation Policy.
Please note that The Client cannot cancel this contract. As set out in section 1, once The Client have been issued with the purchase invoice confirming The Client order, the contract becomes legally binding. Artworks cannot be returned and no refund for Artwork can be given.
Cezanne, Gallery of Fine Arts shall have the right to cancel any order placed on the website at any time prior to the delivery of the Work of Art, without assigning any reason whatsoever.
9. Commissioned Artwork.
Commissioned artwork requires a 50% deposit of the agreed retail price to be paid prior to the Artist starting the commission.
10. Requests to Reserve Artwork.
If The Client would like to reserve any artwork/s a Reservation Fee of 10% per Artwork is required. This is non-refundable and will not be deducted from the retail price of the Artworks on agreement of The Client purchase. Artwork can be reserved for up to 7 days.
11. Right of Third Parties.
No person other than The Client and the Gallery have any right under these terms and conditions other than in respect of section 6 above which confers a benefit on the Artist and is intended to be enforceable by the Artist.
12. Governing Law.
These terms and conditions shall be governed by and construed in accordance with Bangladesh law and the parties irrevocably submit to the non-exclusive jurisdiction of the local courts. Nothing contained in these Terms and Conditions affects The Client’s statutory rights.
শর্তাবলী
নিচে উল্লেখিত এই শর্তাবলী সেজান গ্যালারী অফ ফাইন আর্টস থেকে যেকোনো মৌলিক বা সীমিত সংস্করণের শিল্পকর্ম কেনার ক্ষেত্রে প্রযোজ্য।
ওয়েবসাইটে প্রদর্শিত সমস্ত চিত্র / শিল্পকর্ম শিল্পীর প্রত্যয়নপত্র দ্বারা সমর্থিত।
১ ক্রেতার ক্রয় এবং মূল্য নিশ্চিতকরণ.
ক্রেতাকে একটি ক্রয় চালান প্রদান করা হবে যাতে ক্রেতার ক্রয়কৃত শিল্পকর্মের বিশদ বিবরণ থাকবে। এতে ভ্যাট (প্রযোজ্য হলে) বিক্রয় মূল্য অন্তর্ভুক্ত থাকবে।
২. মূল্য পরিশোধ
শিল্প/চিত্রকর্ম ক্রয়ের সাথে সাথেই এর বিক্রয় মূল্য পরিশোধ করতে হবে, অন্যথায় চুক্তিটি বাতিল হবে।
৩. প্রত্যয়নপত্র।
গ্যালারী দ্বারা ওয়েবসাইটে প্রদর্শিত সকল মৌলিক ও সীমিত সংস্করণের শিল্প/চিত্রকর্ম সত্যায়িত/ প্রত্যয়নপত্র সম্বলিত ।
৪. শিল্প/চিত্রকর্ম ডেলিভারি/সংগ্রহ।
অনলাইন অর্ডার ৫ দিনের মধ্যে ঢাকার ভিতরে এবং ১০ দিনের মধ্যে ঢাকার বাইরে পৌঁছে দেওয়া হবে
ক্রয়ের পরে সম্মানিত ক্রেতাকে গ্যালারী থেকে শিল্প/চিত্রকর্ম টি তাৎক্ষনিক অথবা আলোচনা সাপেক্ষে পরবর্তী সুবিধাজনক সময়ে সংগ্রহ করতে হবে।
ক্রেতার সুবিধার্থে আলোচনা সাপেক্ষে তার ক্রয়কৃত শিল্প/চিত্রকর্ম গ্যালারী কর্তৃক তার কাছে পৌঁছানোর সুব্যবস্থা আছে।
বিদেশে শিল্প/চিত্রকর্ম পাঠানোর জন্য সংশ্লিষ্ট সকল ব্যয় (সরকারী/বেসরকারী) ফি, রপ্তানী কর(প্রযোজ্য হলে) এবং এই সংক্রান্ত অন্য যে কোন খরচ সম্মানিত ক্রেতা কে বহন করতে হবে।
ক্রয়কৃত শিল্প/চিত্রকর্ম টি ক্রয়ের ১৫ দিনের মধ্যে সংগ্রহ করতে ব্যর্থ হলে পরবর্তী দিন গুলোর জন্য দৈনিক হারে সংরক্ষন ফি আরোপিত হবে।
৫. সেবা
শিল্প/চিত্রকর্ম প্রতিস্থাপন অথবা ঝুলানোর জন্য আমাদের আছে দক্ষ কর্মী যারা ক্রেতার রুচি এবং চাহিদা অনুযায়ী এই কাজটি করতে পারদর্শী। এই সেবাটি গ্রহনের জন্য ক্রেতাকে প্রয়োজন অনুযায়ী সার্ভিস চার্জ দিতে হবে।
৬. শিরোনাম এবং ঝুঁকি।
মৌলিক বা সীমিত সংস্করণের শিল্প/চিত্রকর্ম ক্রয় এবং গ্রহন করার পরে এর সকল দায়ভার ক্রেতাকে বহন করতে হবে।
৭. মালিকানা এবং কপিরাইট।
কপিরাইট, ডিজাইন এবং পেটেন্ট অ্যাক্ট ১৯১১ বাংলাদেশ অনুযায়ী, শিল্পকর্মের কপিরাইট সর্বদা শিল্পীর সম্পত্তি থাকবে।
ক্রেতা শিল্প/চিত্রকর্ম কোনও চিত্র তৈরি করতে পারে না এবং যে কোনও সময়ে, কোনও চুক্তি না করা পর্যন্ত কোনও উদ্দেশ্যে কোনও ইন্টারনেট ওয়েবসাইট সহ কোনও তৃতীয় পক্ষের কাছে আর্টওয়ার্কের কোনও চিত্র প্রকাশ বা পুনরুত্পাদনের জন্য প্রকাশ বা জমা দিতে পারে না শিল্পীর সাথে।
৮. ডেটা সুরক্ষা।
এই শর্তাবলীতে সম্মত হয়ে ক্রেতা নিশ্চিত করে যে ক্রেতা ডেটা সুরক্ষা আইন ২০২২ এবং সাধারণ ডেটা সুরক্ষা প্রবিধান ২০২২ এর অর্থের মধ্যে যেকোন ব্যক্তিগত ডেটার সেজান, গ্যালারি অফ ফাইন আর্টস ব্যবহার সম্পর্কে সচেতন এবং সম্মতি দেয়৷ গ্যালারি কোনো তৃতীয় পক্ষের কাছে ক্লায়েন্টের ব্যক্তিগত বিবরণ পাস করবে না। গ্যালারি ক্লায়েন্টের ব্যক্তিগত বিবরণের একটি রেকর্ড রাখবে প্রাথমিকভাবে চালানের উদ্দেশ্যে এবং প্রয়োজনে ক্লায়েন্টের আদেশ সম্পর্কে ক্লায়েন্টের সাথে যোগাযোগের আদান-প্রদানের জন্য।
৯. বাতিলকরণ নীতি।
দয়া করে মনে রাখবেন যে ক্রেতা এই চুক্তি বাতিল করতে পারে না। ধারা ১-এ যেমন উল্লেখ করা হয়েছে, একবার ক্রেতাকে ক্রয় চালান দিয়ে ক্রেতা অর্ডার নিশ্চিত করে জারি করা হলে, চুক্তিটি আইনত বাধ্যতামূলক হয়ে যায়। আর্টওয়ার্ক ফেরত দেওয়া যাবে না এবং আর্টওয়ার্কের জন্য কোনও ফেরত দেওয়া যাবে না।
সেজান গ্যালারী অফ ফাইন আর্টস এর অধিকার থাকবে যেকোনও সময় ওয়ার্ক অফ আর্ট ডেলিভারির পূর্বে ওয়েবসাইটে দেওয়া যেকোনো অর্ডার বাতিল করার, কোনো কারণ দর্শানো ছাড়াই।
১০. শিল্প/চিত্রকর্ম কমিশনিং
কমিশন করা শিল্প/চিত্রকর্ম এর জন্য সম্মত খুচরো মূল্যের ৫০% অগ্রিম কমিশন শুরু করার আগে প্রদান করতে হবে।
১১. শিল্প/চিত্রকর্ম সংরক্ষণ করার অনুরোধ।
যদি ক্রেতা কোনো শিল্প/চিত্রকর্ম সংরক্ষণ করতে চায় তাহলে প্রতি শিল্প/চিত্রকর্ম জন্য বিক্রয় মূল্যের ১০% সংরক্ষণ ফি প্রদান করতে হবে। এটি অ-ফেরতযোগ্য এবং ক্রেতা ক্রয়ের চুক্তিতে শিল্পকর্মের খুচরা মূল্য থেকে কাটা হবে না। শিল্প/চিত্রকর্ম ১৫ দিন পর্যন্ত সংরক্ষণ করা যেতে পারে।
১২. তৃতীয় পক্ষের অধিকার।
ক্রেতা এবং গ্যালারি ব্যতীত অন্য কোনও ব্যক্তির এই শর্তাবলীর অধীনে ধারা ৭ ব্যতীত অন্য কোনও অধিকার নেই যা শিল্পীকে সুবিধা প্রদান করে এবং শিল্পীর দ্বারা প্রয়োগযোগ্য ।
১৩. পরিচালনা আইন।
এই শর্তাবলী বাংলাদেশের আইন অনুসারে পরিচালিত হবে এবং গঠন করা হবে এবং পক্ষগুলি অপরিবর্তনীয়ভাবে স্থানীয় আদালতের অ-একচেটিয়া এখতিয়ারে জমা দেবে। এই শর্তাবলীতে থাকা কিছুই ক্লায়েন্টের বিধিবদ্ধ অধিকারকে প্রভাবিত করে না।
